IP Dispute Resolution

Intellectual Property Dispute Resolution in Indonesia

Resolving intellectual property disputes in Indonesia takes more than litigation. SKC Law’s Dispute Resolution & Advisory team pairs effective strategy with interests-based negotiation and mediation to protect commercial position and resolve conflict efficiently.

Intellectual Property Dispute Resolution services include

Intellectual property rights create value when they are defended well and deployed with a plan. Disputes are part of that reality. A competitor adopts a confusingly similar mark, a product is copied, a licence breaks down, or a launch raises a copyright question that has to be answered before the deadline. How a rights holder responds determines whether the position is protected or eroded.

Litigation is not always the answer. It can be slow, public, and costly, with the potential to damage commercial relationships a business may need to preserve. SKC Law’s Dispute Resolution & Advisory team helps rights holders anticipate risk, protect commercial position, and resolve conflict efficiently, drawing on combined legal, commercial, and field expertise to bridge legal, cultural, and linguistic gaps.

The team works across the full range of Indonesian IP, from trademark, copyright, and neighbouring rights to patents and industrial designs. It offers its dispute resolution service to rights holders directly, and to the overseas IP firms and counsel who instruct us.

SKC Law’s IP Dispute Resolution Services

SKC Law’s Dispute Resolution & Advisory team delivers three core services: strategy, negotiation, and mediation. Each begins with the same approach – accurately reading the client’s position and the commercial outcome they need – and each is available to rights holders directly and to overseas IP service firms and law firms acting for their clients. The team’s intellectual property services span advisory and contentious work, and frequently combine the two.

Strategy

Strategy is about identifying where to play and how to win. The team anticipates threats to a client’s legal position and converts them into a concrete action plan, often before a dispute has fully formed.

This work spans the full IP portfolio. It includes layered brand protection across word marks, multiple device variations, and three-dimensional marks; claim-by-claim patent infringement analysis built from product sampling; and pairing patent with industrial design so that both the functional and aesthetic features of a product are protected.

It also extends to emerging issues – AI-generated content, performers’ rights, consent and moral-rights carve-outs, and cross-border contracting – alongside copyright opinions that draw on cultural-heritage and regulatory frameworks. Where a conflict turns on likelihood of confusion between marks, the analysis is built to support the action that follows, whether opposition, cancellation, negotiation, or litigation.

Negotiation

Negotiation is often the most efficient route to a durable outcome. The team takes an interests-based approach – one that looks past stated positions to what each side actually needs – producing settlements parties can commit to long-term rather than agreements that unravel.

A negotiated settlement can resolve a pirate-trademark dispute and restore a client’s control of its own brand, a position that can then be consolidated through licence structuring and recordal. Warning letters and oppositions frequently open the same conversation from a position of strength. Negotiation also preserves commercial relationships that litigation would damage, which matters when the other party is also a distributor, supplier, or potential partner.

Mediation

Mediation is a streamlined, cost-effective alternative to litigation. It preserves relationships, minimises business disruption, and keeps the outcome in the parties’ hands rather than the court’s. SKC Law’s mediation capability is supported by registered Indonesian mediators.

In practice, the team has conducted mediations before the Directorate General of Intellectual Property (DGIP), including disputes over copyright ownership and royalties on user-generated content platforms. For many IP conflicts, mediation through the DGIP or the National Mediation Centre resolves the matter faster than the Commercial Court, and at lower cost.

Advisory and Technical Depth

On the patent side, the team performs claim-by-claim infringement analysis from product sampling, drafts protectable specifications, and pairs patent with industrial design protection to secure both function and form. On the trademark side, it builds layered protection across word marks, device variations, and three-dimensional marks, enforces well-known marks through warning letters and oppositions, and structures commercial licences and their recordal before the Trademark Office.

On the copyright and design side, the team protects packaging and product get-up by combining copyright and industrial design rights to secure a product’s overall look and commercial value. It handles emerging questions – AI-generated content, performers’ neighbouring rights, freedom of panorama, and government-commissioned works – and acts against copyright infringement in competitor advertising and unfair-competition claims involving design reproduction.

Advisory work extends to trade secret protection, cross-border contracting, and safeguards that keep a client protected when a matter moves quickly.

  • Magnifying glass – technical analysis
  • Product – commercial subject
  • Patent, design, trademark, copyright – layered protection
  • Shield – advisory / protection

How we work

The team’s approach spans risk assessment, strategy, advisory and enforcement, from legal opinions, warning letters and filings to negotiation, settlement or mediation. It consistently meets tight commercial deadlines while maintaining advisory quality and proposing practical safeguards, including expanded indemnities and contractual carve-outs

Working with Indonesia’s IP Institutions

Effective dispute resolution depends on knowing how Indonesia’s IP institutions actually operate. SKC Law maintains established working relationships across them: the Directorate General of Intellectual Property (DGIP), including the Director of Copyright; Patent Office examiners and the Legal Section; the Trademark Office; the Commercial Court and judicial supervisory bodies; and the National Mediation Centre.

These relationships matter in practice. A copyright clearance opinion can be tested against the view of the DGIP Director of Copyright; a patent infringement assessment can be clarified with the Patent Office examiner and Legal Section; and a dispute can be steered toward mediation or the Commercial Court depending on what serves the client.

Patent Infringement Assessment

Personal care & hygiene

A multinational personal-care manufacturer identified similarities between its patented fastening-tape technology and a competitor’s products, and needed to know whether it had a case. SKC Law obtained product samples and performed a claim-by-claim analysis, consulting the Patent Office examiner and Legal Section to clarify the scope of the granted claims. The products were found to fall within multiple claims. The team then assessed the broader patent landscape and advised on enforcement options, with the client prioritising deterrence while preserving its legal remedies.

From Pirate Mark to Consolidated Position

Cosmetics & beauty

An international cosmetics brand faced an operational threat in Indonesia from a pirate trademark registration. SKC Law defended and advised on the dispute, which was resolved through a negotiated settlement that restored the client’s control of its brand. The strategy then shifted from defence to consolidation. The team structured the commercial licence with the client’s local distributor and handled the licence recordal before the Trademark Office, securing legal recognition and enforceability against future infringers.

Clearing a Time-Critical Launch

Apparel & consumer goods

A global apparel retailer planned a collection featuring globally recognised licensed characters set against iconic Indonesian landmarks, and needed to understand its copyright exposure before an approaching launch date. SKC Law delivered a legal opinion assessing copyright scope and the work-for-hire ownership of the landmark illustrations. The analysis combined copyright, cultural-heritage, and regulatory frameworks, drawing on consultation with the DGIP Director of Copyright. The client was able to proceed with the launch on schedule.

Sectors and Clients

SKC Law’s Dispute Resolution & Advisory clients span banking and financial services, luxury apparel and consumer goods, cosmetics and beauty, food and beverage, personal care and hygiene, technology and telecommunications, and publishing, education, and entertainment, among them some of the world’s most recognised brands. The team works with rights holders directly, and with overseas IP law firms and general counsel referring Indonesian IP disputes and advisory matters.

Frequently Asked Questions

Common questions. For specific advice, contact SKC Law at enquiries@skclaw.id.

Litigation is the right tool for some disputes, but it is slow, public, and costly, and it can damage commercial relationships. Where the other party is a distributor, supplier, or potential partner, or where speed and confidentiality matter, negotiation or mediation often delivers a better commercial outcome. SKC Law assesses each dispute and recommends the route, or combination of routes, that best protects the client’s position.

It begins with a risk assessment: reading the client’s legal position, the threats to it, and the commercial outcome they need. From there the team designs an action plan, which may combine advisory work — legal opinions, protectable specifications, portfolio structuring — with contentious steps such as warning letters, oppositions, cancellation actions, or litigation. The aim is to anticipate threats and convert them into a concrete plan before they become costly.

No. Rights holders based outside Indonesia can instruct SKC Law directly, or through their overseas IP firm or counsel. The team handles dealings with the DGIP, the Trademark and Patent Offices, the Commercial Court, and the National Mediation Centre. The client’s role is to confirm ownership of the relevant intellectual property rights in Indonesia and to approve key decisions.

Yes. Mediation before the Directorate General of Intellectual Property (DGIP) or the National Mediation Centre is available for many IP disputes, including copyright ownership and royalty matters. It is typically faster and less costly than the Commercial Court, and it preserves the parties’ relationship. SKC Law’s mediation work is supported by registered Indonesian mediators.

Scope varies widely between a single legal opinion and a multi-track dispute, so the team scopes each matter and provides a quote before work begins. Contact us at enquiries@skclaw.id for an estimate.
